Article 1 · Seller identity

Hereinafter « the Seller ». The purchaser is hereinafter « the Customer ».
Article 2 · Purpose and scope
These Terms of Sale govern the sale of the SmartSearchWP Premium licence on www.smartsearchwp.com, including when purchased with the automatic renewal option (subscription). Every order implies unreserved acceptance of these Terms as in force on the order date.
Article 3 · Product and price
SmartSearchWP Premium is an annual licence granting the right to download and update the premium add-ons of the SmartSearchWP plugin from the Seller’s catalogue, together with priority support.
The licence price is €49.99 per year, VAT included. Prices are shown in euros. The Seller reserves the right to change its prices at any time; the applicable price is the one displayed at the time of the order or, for a renewal, the one communicated to the Customer before the due date.
Article 4 · Auto-renewing subscription (tacit renewal)
The Customer may, optionally and by explicit opt-in (checkbox unticked by default), subscribe to automatic renewal of the licence. In that case:
- A payment mandate is registered with our payment provider Mollie at the first payment.
- The licence is then renewed automatically every year for a twelve (12) month term, by charging €49.99 to the registered payment method. The first automatic charge occurs at the end of the first year, i.e. twelve months after sign-up.
- The Customer is notified of the upcoming renewal by reminder email before each due date.
- The Customer may cancel automatic renewal at any time (see Article 8), free of charge and without justification.
Without opting in, the licence is not renewed automatically and ends at its annual due date.
Article 5 · Payment
Payments are processed by Mollie, a licensed payment service provider. For the subscription, the Customer authorises saving their payment method and its recurring annual charge until cancellation. No card data is stored by the Seller.
Article 6 · Licence delivery
The licence key is generated and attached to the order upon payment validation. The Customer activates the licence by entering their website URL. The licence is intangible; no physical delivery occurs.
Article 7 · Licence scope and behaviour at expiry
During the validity period, the licence grants: installation and updates of premium add-ons through the catalogue, access to new premium add-ons, and priority support.
At licence expiry: already-installed features keep working. The Customer loses updates to premium add-ons (new features, compatibility, add-on security fixes), access to new premium add-ons, and priority support. Updates to the core plugin (distributed free via WordPress.org) are not affected.
Article 8 · Cancelling automatic renewal
The Customer may cancel the subscription at any time, free of charge, from « My Account » then « My subscription » on www.smartsearchwp.com (« Cancel automatic renewal » button), or by writing to hello@smartsearchwp.com. Cancellation stops future charges; the licence stays active until the end of the period already paid. No pro-rata refund is due for the current period, subject to Article 10.
Article 9 · Right of withdrawal
Under the law applicable to distance contracts, consumers have in principle a fourteen (14) day withdrawal period. However, as this is digital content supplied immediately, the Customer, by placing the order, expressly consents to immediate performance of the service and acknowledges losing the right of withdrawal as soon as the licence key is generated. The right of withdrawal does not apply to professional customers acting within their business activity.
Article 10 · Refunds
Refund requests are to be sent to hello@smartsearchwp.com. A refund may be granted, at the Seller’s discretion, in the event of a proven, unresolved malfunction.
Article 11 · Support
Priority support is provided by email at hello@smartsearchwp.com during the licence validity period. It is a human service, not a software feature.
Article 12 · Personal data
The processing of the Customer’s personal data is described in the Privacy Statement.
Article 13 · Liability
SmartSearchWP is provided « as is ». The Seller takes all reasonable care to ensure the service works properly but cannot be held liable for indirect damages, nor for malfunctions related to the hosting environment, third-party extensions, or the OpenAI API key provided by the Customer.
Article 14 · Governing law and jurisdiction
These Terms are governed by Belgian law. In the event of a dispute, and failing an amicable settlement, the competent courts are those of Tournai (Belgium), without prejudice to the mandatory rules protecting consumers.
Article 15 · Amendments
The Seller reserves the right to amend these Terms. The applicable Terms are those in force on the order or renewal date.
